Terms and Conditions

1.    Introduction

1.1.    These Referral Terms are published by Plumbing Outfitters (“we”’, “us” and “our”) in relation to our referral program as displayed on https://plumbing-outfitters.referral-factory.com/W7ENbX/join (the “Referral Program” or “Program”).
1.2.    We offer our customers (each a “Customer” or “Referrer”) the opportunity to refer family, friends, and associates (“Referees”) to claim a promotional offer through the Referral Program.
1.3.    These terms apply to both Referrers and Referees.
1.4.    By participating in the Program, Customers agree to use the Program in the manner specified herein and are bound by these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to act as a Referrer (i.e., to share your unique Referral Link) or participate in the Program in any manner. Referrers and Referees may not participate in the Program where doing so would be prohibited by any applicable law or regulations.

2. The Referral Program

2.1.    To participate in the Program, a Customer may share their unique referral link issued by Plumbing Outfitters with Referees. This link has been automatically generated, but unless shared by the Customer, does not constitute participation in the Program.
2.2.    The Referrer receives a digital $25 Amazon gift card (the “Reward”) when the Referee pays for any of Plumbing Outfitter’s services greater than $50 (“Successful Referral”).
2.3.    In order for the referral to qualify for the Reward, the Referee must be a new customer, over the age of 18, and meet the conditions of their Reward. The Referrer must also be over the age of 18.
2.4.    Rewards will be cumulative. If multiple Successful Referrals are made, multiple Rewards will be sent to the Referrer. 
2.5.    Rewards will be delivered to the Referrer by email within 30 days after the Successful Referral.
2.6.    The Referrer will be notified by email when the Reward has been earned.
2.7.    Rewards expire according to the terms and conditions provided by Amazon.com.
2.8.    Referrers and Referees represent all personal information provided to us is 100% correct and up to date. We may monitor use of the Referral Program or request  proof of identification to verify the identity of Referrers and Referees before issuing Rewards. 

3.    Privacy

All personal information collected and processed as part of this Referral Program will be used in accordance with Plumbing Outfitters’ Privacy Policy, available at https://plumbingoutfitters.com/privacy-policy/. Under the applicable laws and regulations, Plumbing Outfitters shall be responsible for collecting and processing such personal information. 

4.    Restrictions

4.1.    This Program cannot be combined with other Plumbing Outfitters’ referral programs, discounts, vouchers, benefits or incentives. By participating in this Referral Program, we may restrict you from any other promotion, program, discount, or vouchers.
4.2.    Referrers shall not use referral methods that are bothersome to the recipients, including, but not limited to, mass distribution of unsolicited messages. Moreover, your participation in the Referral Program must not violate applicable laws or regulations, including, but not limited to, anti-spam legislation.
4.3.    You must not publish our Referral Program on any sites or platforms that house any adult content, alcohol, tobacco, gambling, games and online casinos, political content, and/or any form of illegal activities. 
4.4.    You should not, at any time, invite or refer people who are personally unknown to you.
4.5.    You must only use our Referral Program for personal use and refrain from its use for commercial purposes. 

5.    Term and Termination

5.1.    This Referral Program will run until terminated by us. We may also, in our sole discretion, notify Referrers and Referees that the Referral Program has ended with immediate effect.
5.2.    Any Successful Referral made before the end of the Referral Program can still participate. However, we may exclude Successful Referrals in our sole discretion made after the termination date of the Program.
5.3.    We may terminate this Referral Program at any time, including Referrers’ and Referees’ participation or the availability of its benefits. 

6.    Exclusive Relationship

6.1.    Referrers and Referees shall refrain from implying any affiliation or legal relationship with us. 
6.2.    Referrers and Referees are never authorized to legally bind our company. 
6.3.    Referrers and Referees shall never create any materials that contain our branding, trademark, or any part of our corporate identity.
6.4.    Referrers and Referees shall not represent themselves as an agent, employee, contractor, fiduciary, or intermediary of Plumbing Outfitters. Nor shall these Terms and Conditions be construed to create an employment, contractor, agent, fiduciary, or joint venture relationship between any Referrer or Referee and Plumbing Outfitters.

7.    Privacy and Information

7.1.    Referrers and Referees shall respect the privacy rights of the people they invite to our Referral Program and/or direct to our website. 
7.2.    Referrers shall always inform Referees about our terms and conditions and privacy policy and must do so before the Referee participates in the Referral Program and/or provides their personal information.

8.    Violations and Termination

8.1.    If we suspect any violations of these terms or otherwise suspect tampering with, fraud, or unreasonable use of our Referral Program, we may, in our sole discretion, cancel the distribution of any Reward, discount, benefit, or payout. 
8.2.    No current or former employee, contractor, or affiliate of Plumbing Outfitters shall participate in the Referral Program, and we may restrict or cancel any such participation with immediate effect. 
8.3.    Referrers and Referees must comply with all applicable laws and regulations and refrain from violating any third-party rights. These rights include any copyright, trademark, or other proprietary rights.

9.    Disclaimer and Indemnification

9.1.    We offer our Referral Program and its benefits only on an “as is” and “as available” basis. We may remove, change, and update the Referral Program in our sole discretion. We will never make any promises or guarantees about the content and information of our Referral Program. We disclaim our responsibility for any information that is incorrect or has errors. 
9.2.    Referrers and Referees shall acknowledge and agree that we can never guarantee any benefit or result from participating in the Referral Program.
9.3.    Referrers and Referees shall defend, indemnify, and hold harmless Plumbing Outfitters from and against all claims, damages, liabilities, losses, expenses, and costs (including reasonable attorney’s fees) arising from their participation in the Referral Program.

10.    Correspondence, Disputes and Refunds

With regards to the distribution of discounts, vouchers, incentives, prizes, awards, Rewards, or other benefits, Referrers and Referees agree that we are under no duty or obligation to correspond with or respond to Referrers or Referees. Moreover, Referrers and Referees understand that we shall never respond to any complaint or accept any dispute regarding the Referral Program, the abovementioned benefits and Rewards are provided “as is”, and we shall never refund, replace, or exchange such benefits and/or Rewards. 

11.    Applicable Law

These Terms and Conditions shall be governed by and interpreted, construed, and enforced in accordance with the laws of the State of Texas. Jurisdiction and venue for all disputes arising under these Terms and Conditions shall be in state and federal courts residing in Travis County, Texas.

12.    Savings Clause

If any portion or provision of these Terms and Conditions is found to be illegal, invalid, or unenforceable, such illegality, invalidity, or lack of enforceability shall not affect or impair the legality, validity, and enforceability of the remainder hereof, all of which shall remain in full force and effect, and the portion or provision found to be unenforceable shall, to the extent possible, be modified in such manner so as to be valid, legal, and enforceable and to best reflect the intention of the parties.

2. The Referral Program

2.1.    To participate in the Program, a Customer may share their unique referral link issued by Plumbing Outfitters with Referees. This link has been automatically generated, but unless shared by the Customer, does not constitute participation in the Program.
2.2.    The Referrer receives a digital $25 Amazon gift card (the “Reward”) when the Referee pays for any of Plumbing Outfitter’s services greater than $50 (“Successful Referral”).
2.3.    In order for the referral to qualify for the Reward, the Referee must be a new customer, over the age of 18, and meet the conditions of their Reward. The Referrer must also be over the age of 18.
2.4.    Rewards will be cumulative. If multiple Successful Referrals are made, multiple Rewards will be sent to the Referrer. 
2.5.    Rewards will be delivered to the Referrer by email within 30 days after the Successful Referral.

11.    Applicable Law

These Terms and Conditions shall be governed by and interpreted, construed, and enforced in accordance with the laws of the State of Texas. Jurisdiction and venue for all disputes arising under these Terms and Conditions shall be in state and federal courts residing in Travis County, Texas.

12.    Savings Clause
